Data Protection Enforcement Manager – Malawi Communications Regulatory Authority (MACRA)
Job Description
The Malawi Communications Regulatory Authority (MACRA) is a statutory body established under the
Communications Act (Cap. 68:01 of the Laws of Malawi) to regulate the provision of services in the communications sector of Malawi, comprising telecommunications, posts and broadcasting.
Under the Communications Act, MACRA is mandated to regulate and monitor the provision of communications services and ensure that, as far as it is practicable, reliable and affordable communications services are provided throughout Malawi. The Vision of MACRA is to ensure
the provision of communication services for a digitally transformed nation.
In order to fulfil its mandate effectively and efficiently with strategic leadership and management, an opportunity has arisen within MACRA to fill various vacant positions. The positions are highly demanding that require persons who have demonstrable capacity to initiate innovations geared
at making MACRA a rejuvenated, vibrant and competitive Authority. The following are the details of the vacant positions.
Data Protection Enforcement Manager (MA4)
Job Purpose
The Data Protection Enforcement Manager will manage enforcement actions related to data protection violations. The role includes handling data breach incidents, managing complaints, conducting investigations, and applying appropriate enforcement measures.
Duties and Responsibilities
i. Develop and implement breach management guidelines and coordinate responses to data breaches.
ii. Manage the complaints-handling process, ensuring timely investigation and resolution of complaints from individuals and organizations.
iii. Conduct investigations into potential violations of the Data Protection Act and recommend enforcement actions where necessary.
iv. Collaborate with legal, IT, and other relevant departments to ensure a comprehensive approach to
enforcement.
v. Maintain records of enforcement actions, investigations, and outcomes securely and transparently.
vi. Coordinate with external law enforcement and judicial bodies where required for data protection
cases.
vii. Develop and deliver training programs for staff on enforcement procedures and data protection law.
viii. Prepare detailed reports on enforcement activities for submission to senior management and relevant authorities.
ix. Monitor trends and patterns in data protection breaches and develop strategies to mitigate future
risks.
x. Provide expert advice to the Authority on matters related to enforcement and legal compliance.
xi. Ensure effective communication with complainants and other stakeholders regarding the status and outcomes of enforcement processes.
xii. Foster international collaboration with other data protection authorities to strengthen cross-border enforcement capabilities.
Educational, Professional Qualifications and Experience
i. Master’s Degree in Law, Computer Science, Information Technology, or a related field;
ii. Advanced training or certification in data protection, investigations, or enforcement is an added advantage;
iii. Minimum of 5 years’ experience in regulatory enforcement, investigations, or compliance.
Key Competencies
i. Strong knowledge of privacy laws, enforcement protocols, and the Data Protection Act
ii. Proven track record in handling complex investigations and complaints;
iii. Excellent communication and negotiation skills;
iv. Ability to collaborate effectively with legal and regulatory bodies
