Head of Data Protection – Malawi Communications Regulatory Authority
Job Description
The Malawi Communications Regulatory Authority (MACRA) is a statutory body established under the Communications Act (Cap. 68:01 of the Laws of Malawi) to regulate the country’s communications sector. Under the Communications Act of 2016, MACRA is mandated to regulate and monitor the provision of communications services and ensure that, as far as it is practicable, reliable and affordable communications services are provided throughout Malawi. The Vision of MACRA is Communication Services for a digitally transformed Nation and in order to fulfill its mandate effectively and efficiently with strategic leadership and management, an opportunity has arisen within MACRA to fill various vacant positions.
The positions are highly demanding and require persons who have demonstrable capacity to initiate innovations geared at making MACRA a rejuvenated, vibrant and competitive Authority.
The following are the details of the vacant positions.
Head of Data Protection (MA3)
The position exists to oversee the Management of the Data Protection Unit (DPU) and provide direction in the management and enforcement of Data Protection in line with the provisions of the Data Protection Act.
Key Duties and Responsibilities
i. Lead and manage the Data Protection Unit;
ii. Provide strategic direction and oversight to the Authority’s data protection related mandates;
iii. Regulatory oversight on implementation investigations and enforcement of the Data protection Act.
iv. Ensure that all relevant legal and regulatory instruments to support the implementation of the Data Protection Act are in place.
v. Oversight over monitoring and assessment of compliance of organizations and entities with the Data Protection Act;
vi. Contribute towards policy development related to data protection and provide expert advice and
recommendations to policy makers and the Authority on data protection related matters;
vii. Ensure collaboration with Data Protection Authorities in other jurisdictions as well as participation with international bodies dealing with data protection issues.
viii. Prepare detailed reports and briefs on the Authority’s data protection related activities and performance to relevant stakeholders
ix. Any other duties related to oversight of the Data Protection Unit
Qualification & Experience
- Master’s Degree in Law, Computer Science, or Information Technology.
- Specialized training in data protection, privacy law or information security
- Membership in relevant professional bodies or association (e.g. International Association of Privacy Professionals) will be added advantage
- Minimum of at least 10 years’ experience at Senior Management Level.
- Significant experience in a regulatory or enforcement role preferably within a similar organization
- Thorough understanding of data protection principles, privacy laws and regulations
- Proficiency in interpreting and applying legal frameworks, regulations and the Data Protection Act.
- Familiarity with data Protection impact assessments
